Yeah having your gun sit in evidence after a shooting is ubiquitous across the board. Mine sat at DOJ for over 18 months in my last IOS.
I have also heard the horror stories about DA’s doing X,Y and Z because of features. I’ll tell you this. I have been a firearms instructor for 31 years. A long time ago I started to notice that everyone knew about someone that this allegedly happened to. Then when pressed, they would say something like, oh well I don’t know the person, but a friend told me about a friend it happened to. About ten years ago I started challenging anyone making this claim to provide me an actual criminal or civil case; an actual case that can be looked up and verified, where an aftermarket feature was the deciding factor between a shoot being justified vs not. To this date, no one has given me one. If you have to pull a gun and defend yourself, it’s either going to be deemed a justified homicide or use of force or it isn’t, based on the circumstances. Having a weapon light, an extended magazine release, etc aren’t going to make a clean shoot any less clean. Conversely, a questionable shoot isn’t gonna be less questionable because your gun was bone stock. My point is this. Don’t put stupid shit on your carry gun like a FRT or the stupid barrel inscriptions that say “smile and wait for flash” but do make your weapon as effective for you as possible based on your skills, needs and training. As long as you can sit on the stand and say, “Yeah I put that optic on the because in training, I’m demonstrably more accurate with it, making me a safer shooter.” Or “I put stippling on my grip because it allows me to hold onto the gun better, meaning it’s less likely for me to drop it and have an accident or have it taken away” you’re gonna be fine. I think people overthink this. It’s an inherently deadly weapon. Using it means you acknowledge that and made the choice to use it anyway because the circumstances required it. It’s a tool for a lethal situation. “Why did you add that optic on the gun you shot my client with Mr Smith?” Because I’m most accurate with the weapon configured that way and accuracy means I’m less likely to miss and hit an unintended person or target when I was defending my life from the human impersonating piece of shit you’re representing councilor.
